UN DISPUTE TRIBUNAL FORMS/FILING GUIDELINES

FORMS

The forms listed on this page are to be used to make submissions to the UN Dispute Tribunal (UNDT), either to initiate a new application, or to make additional filings in an ongoing UNDT case. The first form listed below is the Application on Merits, the form to be used to file an application on the merits with the UNDT, and initiate the formal legal process.
Even if you eventually only use a few of these forms you might want to take the time to download and/or review all of them carefully. That may help you to thoroughly understand UNDT proceedings and the various options you have while they are taking place.

Application for Suspension of Action pending Management Evaluation (Applicant) An application to suspend the implementation of an administrative decision. UNDT/F.3E Yes
Motion for Extension of Time to File Reply (Respondent) or Comply with Order (Applicant/Respondent) Motion for an extension of time to file their reply to an application or comply with an order. UNDT/F.4E Yes
Motion to File a Friend-of-the-Court Brief (staff association) Request by an association which may assist the UNDT in its deliberations. UNDT/F.5E Yes
Application for intervention (person not party to a case but who is entitled to appeal the contested administrative decision) A motion by a person not party to a case asking the UNDT to intervene in the case before the judgment is made. UNDT/F.6E Yes
Application for Interpretation of Judgment (Applicant/Respondent) A request for the interpretation of the meaning or scope of the final judgment.? UNDT/F.7E Yes
Motion for Correction of Judgment (Applicant/Respondent) A motion to correct a mistake or error made in the judgment of your case (refers to clerical and arithmetical mistakes, or errors from accidental slip or omission). UNDT/F.8E
Application for Revision of Judgment (Applicant/Respondent) An application to revise a judgment on the basis of the discovery of a decisive fact that was unknown to the Tribunal and the applying party at the time the judgment was rendered. UNDT/F.9E Yes
Generic Submission Form (Applicant/Respondent) A form used to submit supporting documentation to the UNDT. UNDT/F.10E Yes
Motion for Interim Measures pending Proceedings (Applicant) A motion by the Applicant asking the UNDT to order an interim measure, including suspension of the implementation of the contested decision. UNDT/F.11E Yes
A form authorizing counsel to act as the legal representative of the Applicant before the UNDT. UNDT/F.12E Yes
UNDT Respondent Reply Form (Respondent) The Respondent's reply to the application filed with UNDT. UNDT/F.13E Yes

GUIDELINES FOR FILING APPLICATIONS AND FORMS WITH UNDT

The downloadable application and submission forms for UNDT listed above may be completed in any one of the six official languages of the 51勛圖. Please note that some forms have page limits. All should be in font Times New Roman, font size 12, line spacing of 1.5 lines. The form should be submitted through the e-filing portal unless access to the e-filing portal is not available. GUIDELINES ON THE FILING OF MOTIONS

At any point in case proceedings, or during a hearing, a party to the proceedings may file one or several motions and the other party may respond, using the forms above, including the generic submission form, which is used to file supporting documentation. GUIDELINES ON CITATION

When addressing the UNDT, or when preparing written submissions to file with the UNDT, you should always use correct references to relevant legal instruments and authorities, including judgments. When referring to the judgments or orders or cases of the UNDT, you are expected to follow these guidelines on citation:

CITING OF JUDGMENTS OF THE DISPUTE TRIBUNAL AND APPEALS TRIBUNAL

A full citation includes the Applicant's last name (italicized) and the Dispute Tribunal's judgment number. For example: Smith UNDT/2011/001. For citing UNAT judgments please use the following model: Smith 2012-UNAT-063.

CITING OF ORDERS OF THE DISPUTE TRIBUNAL

A full citation includes the Applicant's last name (italicized) and order number, identifying in parentheses the registry ("GVA" for Geneva, "NY" for New York and "NBI" for Nairobi) and the year the order was issued. For example: Smith Order No. 1 (NBI/2011).

CITING OF CASES GENERALLY

When referring to the case law of the UNDT, include citations to the Tribunal's judgments and orders. If no judgment or order is available, it is permissible to refer to the case number, followed by a parenthetical with the Applicant's last name. For example: Case No. UNDT/GVA/2011/001 (Smith).
