On 6 June 2024, the Counter-Terrorism Committee (CTC) will hold an open briefing on ¡°The criminalization of terrorist offences and strengthening of international cooperation in bringing terrorists to justice¡±.
Criminalizing acts of terrorism in a clear and precise manner in accordance with the rule of law, provisions of the international counter-terrorism conventions and protocols, and relevant Security Council resolutions serves to stop impunity and strengthen international cooperation on bringing terrorists to justice. Yet, the Counter-Terrorism Committee¡¯s assessments show that Member States continue to develop and implement counter-terrorism legislation using many different approaches. This may complicate international cooperation, especially formal cooperation such as mutual legal assistance and extradition, which are premised upon the principle of dual criminality. In addition to complicating international cooperation on criminal matters, overbroad or vague criminalization of terrorist offences creates a risk of human rights violations which can cause further obstacles to effective international legal cooperation on bringing terrorists to justice.
The open briefing will bring together representatives from Member States and international organizations, as well as civil society, to explore how international cooperation on bringing terrorists to justice in accordance with resolution 1373 (2001) and other resolutions can be enhanced through reliance on clear and precise legislation that criminalizes terrorist acts in accordance with the rule of law and relevant international standards. It will also be an opportunity to examine the relationship between well-codified criminal offences and international cooperation to highlight why one is an important precondition for the other.
